Coverage of the Rental Damage Waiver (RDW)
Coverage of the SEIS (Specialty Equipment Insurance Services) Sponsored damage waiver program to The Boyz Rentals and Towing equipment includes but is not limited to protection from the following, provided that you comply with the terms and conditions of the rental agreement:
Vermin Infestation
The Damage Waiver is not Insurance
The RDW does not protect you from liability to others, or The Boyz Rentals, arising out of the possession, use, operation, or transport of Equipment rented, nor does it cover loss of, or damage to, any Equipment contents.
You WILL be Charged for the Damage Waiver Unless You Provide Evidence of Insurance.
The Damage waiver will be charged on all rentals unless you deliver a certificate of insurance from an insurance company acceptable, meeting all of the insurance requirements. If effective insurance is not maintained, you will be charged the Damage Waiver even if you produce a certificate of insurance at a later date.
Example of Losses and Damage Not Covered by the Damage Waiver
1. Use or operation of the Equipment in a manner inconsistent with it's intended purpose or design; or as otherwise prohibited by, or in breach of, the rental agreement. This includes overloading/exceed the listed capacities, “Misuse and/or Abuse”, and/or similar events.
2. The unauthorized use, or negligent or willful act of you; your employee/s, or agents; or improper use of the equipment, overloading or improper load distribution, lack of care for, or neglect of the equipment.
3. The delivery, pickup, or movement of the equipment.
4. Damage or loss to third parties person or property resulting from any occurrence or accident involving the rental unit, whether on-road or off-road.
5. Damage to a unit’s components especially from artificially generated electric current (such as jump starting), including electric arcing, that disturbs electrical devices, appliances or wires. This exclusion does not apply to loss or damage caused by lightning.
6. Tire or wheel repair and/or replacement.
7. Fee’s for towing, impound, toll’s, speeding, storage, or other similar expenses.
8. Intentional malicious mischief, dishonesty, or criminal acts performed by you, any of your partners, officers, directors, trustees, authorized representatives or employees.
9. Damage caused by any third party not expressly covered under the Damage Waiver and/or Rental Contract.
11. Unexplained loss, damage, or mysterious disappearance.
12. The ingestion or the drawing in of any foreign object; rocks, dirt, trash or any other material, that causes damage to the Covered Property.
13. “Downtime costs”, delay’s, loss of use, loss of market valued, or other consequential loss of any nature.
Deductible
The SEIS Sponsored RDW carries a deductible of up to $2,500. The minimum deductible charged is $1,000. The Boyz Rentals may elect to financially contribute towards the deductible based on a case-by-case evaluation process. There is no guarantee of contribution, and The Boyz Rentals holds the right to refuse or withdraw contribution for any reason at any time, especially if new facts or circumstances develop.
Conditions
Damage Waiver shall be void if any information was concealed or misrepresented any material fact or circumstances concerning this insured or the subject thereof; or in case of any fraud or false swearing by the assured touching any matter related to this Damage Waiver or the subject thereof; whether before or after loss.
For the Damage Waiver to cover damage from the above you must (1) take reasonable precautions against any possible damages, (2) notify The Boyz Rentals immediately of any damage or other such loss event and (3) deliver to The Boyz Rentals a copy of police report documenting any theft, loss, vandalism and or malicious mischief, within 1 business day of your first knowledge of such event.
Acceptance:
Renter Hereby Accepts the RDW (Rental Damage Waiver) and agrees the above listed terms, conditions, liabilities, and other statements. Renter Hereby Accepts the issuing party of the RDW (SEIS) has ultimate and final decision in coverage or denial of the claim and Renter may still be liable for any and all loss, damage, or other claims to the equipment during their rental, use, possession, or care.

Refusal:
Renter Hereby Refuses RDW (Rental Damage Waiver) and agrees to be FULLY, UNQUESTIONABLY, and UNDENIABLY financially responsible for any-and-all loss, damage, or other claims to the equipment during their rental, use, possession, or care.
Signatures
This contract may be signed electronically or in hard copy. If signed in hard copy, it must be returned to or scanned by the Business for valid record. Electronic signatures count as original for all purposes. By typing or e-signing their names as signatures below, all parties involved agree to the terms and provisions of this entire agreement as applicable to their rental.
